Agreement to Terms 01

These Terms of Service ("Terms") govern your use of the Canstrux Inc. website at canstrux.ca and your engagement with our construction services. By accessing our website or engaging Canstrux Inc. for any service, you agree to be bound by these Terms.

These Terms apply to all website visitors, prospective clients, and clients who enter into a contract with Canstrux Inc. If you do not agree to these Terms, please do not use our website or engage our services.

Use of Our Website 02

You may use our website for lawful purposes only. By accessing canstrux.ca, you agree not to:

• Use the site in any way that violates applicable federal or provincial law in Canada
• Transmit unsolicited or unauthorized advertising or promotional material
• Attempt to gain unauthorized access to any part of the site or its underlying systems
• Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the site
• Reproduce, duplicate, copy, or resell any content on the site without our written consent
• Use the site to impersonate any person or entity

We reserve the right to terminate access to any user who violates these conditions without notice.

Our Services 03

Canstrux Inc. provides residential and commercial construction services in Calgary, Alberta and surrounding communities, including:

• Building envelope restoration and exterior cladding
• Carriage home construction
• Modular home construction (single and multi-family)
• Residential renovations and additions
• Commercial tenant improvements

All services are delivered in accordance with the specific terms outlined in your Builders Contract. The information on our website is for general informational purposes and does not constitute a binding offer to provide services at any specific price or timeline.

We reserve the right to decline any project inquiry at our discretion, without being required to provide a reason.

Quotes & Proposals 04

Any estimate, quote, or proposal provided by Canstrux Inc. is:

• Based on information available at the time of the site visit and assessment
• Subject to adjustment if site conditions, scope, or material costs change materially
• Valid for 30 days from the date of issue unless otherwise stated in the proposal
• Not a binding contract until both parties have executed a formal Builders Contract

Proposals are delivered through Client portal, our project management platform. You will receive a personal invitation to access your project portal upon acceptance of a proposal.

Payment Terms 05

Specific payment terms, including deposit amounts, milestone payments, and final payment schedules, are set out in your Builders Contract. The following general terms apply unless otherwise specified in your contract:

• A deposit is required prior to the commencement of any work, as specified in your contract
• Progress payments are due at agreed milestones and within the timeframe specified in your contract
• Final payment is due upon completion of the project and prior to occupancy or handover
• Invoices not paid within the agreed timeframe may attract interest as set out in your contract
• Canstrux Inc. reserves the right to suspend work on projects with outstanding overdue payments

All prices are in Canadian dollars (CAD) and are exclusive of applicable taxes unless otherwise stated.

Changes & Cancellations 06

Change orders: Any changes to the scope of work after contract execution must be agreed to in writing via a formal change order. Change orders may affect the project timeline and total contract value. No additional work will be performed without a signed change order.

Cancellations: Cancellation terms are set out in your Builders Contract. In general:

• Cancellation prior to commencement of work may result in forfeiture of the deposit to cover mobilization, planning, and pre-construction costs already incurred
• Cancellation after work has commenced will require payment for all work completed to date, plus any materials ordered or procured for the project
• Force majeure events (severe weather, governmental action, etc.) may affect timelines without constituting a breach of contract

Warranties 07

Canstrux Inc. warrants its workmanship on all completed projects. Warranty terms vary depending on the type and scope of work and are detailed in your Builders Contract.

Our warranty obligations:

• Cover defects in workmanship arising from the construction work performed by Canstrux Inc.
• Do not cover damage resulting from misuse, neglect, unauthorized alterations, or normal wear and tear
• Do not cover defects in materials where those materials carry a separate manufacturer's warranty
• Require written notice of any warranty claim within the warranty period

Manufacturer warranties on materials and products are passed through to the client where applicable. Canstrux Inc. will assist in processing warranty claims with suppliers where possible.

Access to your Client portal project portal remains active throughout your warranty period to facilitate communication and documentation.

Intellectual Property 08

All content on the Canstrux Inc. website, including text, images, logos, graphics, design elements, and the overall site design, is the property of Canstrux Inc. or its licensors and is protected by Canadian copyright law.

You may not reproduce, distribute, modify, or create derivative works from any content on our website without our prior written consent. The Canstrux Inc. name, logo, and brand elements are trademarks of Canstrux Inc. and may not be used without authorization.

Project photos taken on client properties remain the property of Canstrux Inc. and may be used for marketing, portfolio, and promotional purposes unless you specifically request otherwise in writing before the project begins.

Limitation of Liability 09

To the fullest extent permitted by applicable law:

• Canstrux Inc. is not liable for any indirect, incidental, consequential, or punitive damages arising from your use of our website or our services beyond those covered by your Builders Contract
• Our total liability in connection with website use is limited to the greater of CAD $100 or the amount paid by you for the specific service giving rise to the claim
• We do not warrant that our website will be uninterrupted, error-free, or free from viruses or other harmful components

Nothing in these Terms limits our liability for death, personal injury, fraud, or any other matter where limitation of liability is prohibited by law.

Liability in relation to construction services is governed by your Builders Contract and applicable Alberta building and construction law.

Governing Law 10

These Terms are governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Alberta.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
